2. Website terms

By accessing or using this website, you agree to be bound by these terms. If you do not agree, please do not use the website.

We may change these terms from time to time by posting an updated version on this page. The "effective date" at the top tells you when the most recent change was made. Continuing to use the website after that date means you accept the updated terms.

You may use this website to learn about Digital For People, read our published content, and contact us. In return, you agree:

  1. not to use the website in any way that is unlawful, fraudulent or harmful;

  2. not to attempt to gain unauthorised access to the website, the servers on which it is hosted, or any related systems;

  3. not to introduce viruses, trojans, worms, logic bombs or other malicious or technologically harmful material;

  4. not to engage in any automated or systematic data extraction (scraping, mirroring, crawling beyond standard search-engine indexing) without our prior written permission;

  5. not to use the website in any way that imposes a disproportionate burden on its infrastructure.

3. Intellectual property

All content on the website — including text, graphics, logos, images, videos, software, downloadable assets, and the look and feel of the site itself — is owned by Digital For People or licensed to us, and is protected by copyright, trademark and other intellectual property laws.

You may view, download a single copy of, and print pages from the website for your own personal or internal business reference, provided you do not modify the content and you preserve all copyright and proprietary notices. Any other use — including reproducing, republishing, distributing, transmitting or commercially exploiting any part of the website — requires our prior written consent.

"Digital For People" and our logo are trademarks of Digital for People Ltd. and/or Digital for People LLC. You may not use them without our prior written permission.

4. Feedback

If you send us suggestions, ideas, feedback or other information through the website (for example, via the contact form), you grant us a worldwide, royalty-free, perpetual, irrevocable, transferable, sub-licensable licence to use, reproduce, modify, publish, distribute and otherwise exploit that material for any purpose, without attribution and without any obligation to you. Do not submit anything that you do not wish to license to us on these terms, and do not submit anything confidential without first agreeing a non-disclosure agreement with us in writing.

5. External links

The website may link to third-party sites that we do not control. We provide those links for convenience only. We do not endorse, and we are not responsible for, the content, policies or practices of any linked site.

6. No professional advice

The content on this website is provided for general information only. It does not constitute professional advice (technical, legal, financial or otherwise) and you should not rely on it as a substitute for advice from a qualified professional engaged on your specific circumstances.

7. Disclaimer of warranties

The website is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we exclude all express and implied representations, warranties and conditions of any kind in connection with the website — including, without limitation, warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, uninterrupted availability and freedom from errors or viruses.

Some jurisdictions do not allow the exclusion of certain implied warranties, so some of the above may not apply to you. In those jurisdictions, our liability is limited to the maximum extent permitted by law.

8. Limitation of liability

Nothing in these terms excludes or limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded or limited under applicable law.

Subject to that, to the fullest extent permitted by law, we will not be liable to you for any:

  • loss of profits, revenue, business, contracts or anticipated savings;

  • loss of goodwill, reputation or opportunity;

  • loss or corruption of data;

  • indirect, special or consequential loss

arising out of or in connection with your use of the website, even if we have been advised of the possibility of such loss.

Our total aggregate liability to you arising out of or in connection with your use of the website (whether in contract, tort including negligence, or otherwise) will not exceed one hundred pounds sterling (£100) or one hundred and fifty United States dollars ($150), whichever is greater.

9. Indemnity

You agree to indemnify and hold us harmless from and against any claim, demand, loss or expense (including reasonable legal fees) arising out of: (a) your breach of these terms; (b) your misuse of the website; or (c) your violation of any law or the rights of any third party.

10. Governing law and jurisdiction

If you are located in the United Kingdom, the European Economic Area, Switzerland or anywhere outside the Americas: these terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction to settle any dispute arising out of or in connection with these terms.

If you are located in the United States, Canada or anywhere else in the Americas: these terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. You and we submit to the exclusive jurisdiction of the state and federal courts located in New Castle County, Delaware for any dispute arising out of or in connection with these terms.

This split applies only to disputes about the website itself. Disputes about specific consulting engagements are governed by the law and jurisdiction stated in the Master Services Agreement or Statement of Work for that engagement.

11. Severability

If any provision of these terms is held to be invalid or unenforceable, the remaining provisions remain in full force and effect.

12. Entire agreement

These terms, together with our Privacy Policy and Cookie Policy, are the entire agreement between you and us in relation to your use of the website, and they supersede any prior agreement on that subject.
